KasaIA Privacy Policy

This Policy explains what personal data we process when you use KasaIA (the "Service"), for what purpose, who we share it with and what rights you have over it.

The data controller is KaasifyAI Corp (sociedad anonima constituida en la Republica de Panama), with registered address at PH Las Olas 1, PB A, Vista Mar, San Carlos, Panama Oeste, Panama. You can reach us at contacto@kaasifyai.com.

Data we collect

When you use KasaIA we process your name and email address, your password in encrypted form, the property data you enter, the photographs you upload, the generated content, your credit history and the billing data processed by Stripe.

We also automatically collect technical data necessary to operate the Service: IP address, browser and device type, access date and time, and error and feature usage logs.

We do not use Google Analytics, Meta Pixel or equivalent third-party advertising tracking tools. We also do not sell or transfer your personal data to third parties for advertising purposes.

How we use the data

We process your data for the following purposes:

Providing the Service: creating and maintaining your account, processing the material you upload and generating the outputs you request.
Processing payments: managing subscriptions, credits and billing.
Communicating with you: sending operational notices, changes to the terms, security alerts and responses to your enquiries.
Improving and securing the Service: diagnosing failures, preventing abuse and fraud, and measuring feature usage in aggregate form.
Complying with legal obligations: retaining accounting and tax records and responding to requests from competent authorities.

The legal basis for processing is performance of the contract you enter into by accepting the Terms of Service, our legitimate interest in operating and securing the Service, compliance with legal obligations and, where applicable, your express consent.

Third-party services

To provide the Service we share data with providers acting as processors on our behalf and under our instructions. Depending on the features you use, these providers may include:

Payment processing: handles billing and card data. We do not store full card details.
Hosting and file storage: stores the material you upload and the generated content.
Artificial intelligence generation: processes your inputs to produce images, video, audio or text.
Email delivery: delivers operational and account notifications.
Messaging: sends and receives messages when the feature is enabled.
Public-source data collection: gathers publicly accessible information when you use prospecting features.
Background processing: runs tasks that take longer than a web request.

Each provider receives only the data necessary for its function. The complete and current list of providers used by KasaIA, including their identity and location, is available on request by writing to contacto@kaasifyai.com.

Where the data is hosted

Your data is hosted on a private server located in the eastern United States.

International data transfers

If you reside outside the United States, your personal data is transferred to and stored in the United States, a country that may not provide a level of data protection equivalent to that of the law of your country of residence.

By using the Service you give your informed consent to that international transfer. We apply reasonable technical and organizational measures to protect your data regardless of where it is processed.

If you do not agree with this transfer, you should not use the Service.

Retention periods

Account data: while the account is active and for up to twelve (12) months after closure.
Uploaded material and generated content: until you delete it or close your account. Effective deletion from backup copies may take up to thirty (30) calendar days.
Billing records: for the period required by applicable accounting and tax law, which may exceed the periods above.
Technical and security logs: up to twelve (12) months.

Once those periods expire, data is deleted or irreversibly anonymized.

Your rights

Regardless of where you reside, we recognize the following rights over your personal data:

Access: obtain confirmation of whether we process your data and a copy of it.
Rectification: correct inaccurate or incomplete data.
Erasure: request deletion of your data, unless we must retain it under a legal obligation.
Portability: receive your data in a structured, commonly used format.
Objection: object to processing based on our legitimate interest.
Restriction: request that we restrict processing while a dispute is resolved.
Withdrawal of consent: withdraw consent at any time, without affecting the lawfulness of prior processing.

How to exercise your rights

Write to contacto@kaasifyai.com stating the right you wish to exercise and the email address associated with your account. We may request additional information to verify your identity before acting on the request.

We will respond within 30 calendar days of receiving the request. Exercising these rights is free of charge.

If you believe we have not properly handled your request, you may lodge a complaint with the competent data protection authority in your country of residence.

Security

We apply reasonable technical and organizational measures to protect your data, including encryption of traffic in transit, password storage using hash functions, access controls and activity logging.

No system is completely secure. Should a security breach significantly affect your personal data, we will notify you without undue delay through the contact method associated with your account.

Minors

The Service is not directed at persons under 18 years of age and we do not knowingly collect personal data from minors.

If we become aware that a minor has provided us with personal data, we will delete it. If you are a parent or legal guardian and believe a minor in your care has provided us with data, please write to contacto@kaasifyai.com.

Changes to this policy

We may update this Policy. Material changes will be notified at least thirty (30) calendar days in advance by email or through a prominent notice within the Service. The effective date at the top of this document indicates the most recent update.
